Polk County’s Land Development Code is already one of the more ADU-friendly in Central Florida. The county permits “accessory living quarters” in most residential zones, allows both detached and attached configurations, and does not prohibit independent kitchens. That makes Polk a comparatively forgiving county for ADU projects today, under current code.
Florida’s 2026 ADU preemption bill (SB 48) did not become law, so any further change (including removing owner-occupancy on larger parcels) would now come through the county’s own ordinance process rather than state mandate. Combined with the relatively low land and construction costs in Polk compared to Orange or Seminole, this makes Polk one of the better-penciling counties for ADU projects intended as long-term rental income.
